This Legal Statement and Terms of Service explains how those services operate, what role Global Canadian Pharmacy has in processing an order, and which conditions apply when a customer requests prescription or non-prescription medication through the service.

These terms apply specifically to the pharmacy services available through Global Canadian Pharmacy. Matters relating to website content, privacy, cookies and returns are addressed separately in the policies provided for those purposes.

Scope of Our Pharmacy Services

Global Canadian Pharmacy helps customers submit medication orders and, where required, provide the prescription information needed for pharmacy fulfillment.

The availability of a product on the website does not mean that it can be supplied to every customer in every location. Medication availability can depend on the product itself, the dispensing pharmacy, the prescription provided, current inventory and the requirements that apply to the order.

Some medications are straightforward to process. Others may require additional verification before a pharmacy can dispense them.

For this reason, an order should be understood as a request for pharmacy fulfillment. It is not finally approved simply because a product appears in the catalog or has been added to the shopping cart.

Role of Global Canadian Pharmacy

There is an important difference between operating an online pharmacy service and making a professional decision about a prescription.

Global Canadian Pharmacy may assist with receiving an order, collecting the information needed to process it, communicating with the customer and coordinating the steps required for fulfillment. When a separate pharmacy is responsible for dispensing the medication, the professional decision to fill that prescription remains with the pharmacist responsible for the order.

Global Canadian Pharmacy does not override that decision. Where a prescription cannot be verified, information is incomplete or a pharmacist determines that the medicine should not be dispensed, the order may be held or declined. Unless a particular service expressly states otherwise, use of Global Canadian Pharmacy does not create a physician-patient relationship and does not authorize the website itself to diagnose a medical condition or independently change a patient’s prescribed treatment.

Professional Pharmacy Review

Prescription fulfillment involves more than matching the name of a drug with the name shown on an order. The dispensing pharmacy may need to review the medication, strength, dosage form and directions before the prescription can be prepared. Information about the patient may also need to be clarified when it is relevant to dispensing.

A pharmacist may:

  • request additional prescription information;
  • seek clarification of a dose or direction;
  • confirm information with the patient or prescriber;
  • decline to dispense a medication when professional or legal requirements are not satisfied;
  • request a new or updated prescription before the order continues.

The fact that a customer has ordered or previously received the same medication does not remove the pharmacist’s responsibility to review a new dispensing request.

Prescription Requirements

Prescription medications can only be processed when the requirements applicable to that medication and dispensing pharmacy have been met. Depending on the circumstances, a pharmacy may require an original prescription, an authorized electronic prescription, a verified copy or another acceptable form of prescription documentation before dispensing. The prescription must contain enough information to identify the medication, patient, strength and directions where applicable. It must also remain valid for the requested dispensing.

Submitting a prescription does not guarantee that it will be accepted. A prescription that appears incomplete, altered, expired or otherwise unsuitable for dispensing may require additional verification. Global Canadian Pharmacy may stop processing an order when the necessary prescription requirements have not been satisfied.

Independent Dispensing Pharmacies

Where an order is filled through a separate dispensing pharmacy, that pharmacy operates as an independent professional provider and follows the requirements that apply in its own jurisdiction. This means Global Canadian Pharmacy may assist with the order without controlling every professional decision made by the dispensing pharmacist.

A dispensing pharmacy may have its own requirements concerning prescription verification, permitted quantities, refill intervals or products it can supply. These requirements can occasionally change the way an order is processed. If additional action is needed from the customer, Global Canadian Pharmacy may contact the customer before fulfillment continues.

International Fulfillment

Depending on the medication and the dispensing arrangements available, some orders may involve pharmacies or pharmaceutical sources located outside Canada. The name Global Canadian Pharmacy should therefore not be understood as a statement that every medication offered through the service is manufactured in Canada or that every order is necessarily dispensed from a Canadian location.

A medicine supplied through another country may have:

  • different manufacturer packaging;
  • a different trade name;
  • product identification used in that market;
  • labeling prepared according to local requirements;
  • a manufacturer different from the one commonly seen in Canada.

The country where a medicine is manufactured may also differ from the country where it is dispensed.

When an international dispensing source is involved, the pharmacy responsible for filling the order remains subject to the professional and regulatory requirements applicable where that pharmacy operates.

Territorial and Regulatory Restrictions

Taxes and Import Responsibility

An international medication order may be subject to taxes, customs duties, import charges or other fees imposed by authorities in the destination country. These charges are separate from the medication and service costs shown by Global Canadian Pharmacy unless the order information specifically states that a particular fee is already included.

Customers are responsible for duties, taxes or government charges imposed on their shipment by the destination jurisdiction. Import rules can also differ considerably from one country to another. A medication that can be legally dispensed by a pharmacy in one jurisdiction may still be subject to restrictions when sent across a national border. Customers placing an international order should make sure that receiving the medication is permitted under the requirements that apply at the delivery destination.

Order Requests and Acceptance

Submitting an order creates a request for pharmacy service. It does not create an unconditional obligation to supply the medication. Before an order can move forward, Global Canadian Pharmacy or the dispensing pharmacy may need to confirm product availability, prescription information, payment details or other information required for fulfillment.

An order may not be accepted when:

  • the medication is unavailable;
  • a required prescription has not been provided;
  • the prescription cannot be verified or filled as submitted;
  • the product or quantity cannot be supplied to the destination;
  • there is an obvious error in product or pricing information;
  • information connected with the order suggests fraud, misuse or an unlawful transaction;
  • the dispensing pharmacist decides that the prescription should not be filled.

If an order cannot be completed, any payment or refund issue resulting from that decision is handled under the policy applicable to the transaction.

Customer Representations

Customers using Global Canadian Pharmacy are expected to use the service for legitimate pharmacy purposes. By submitting an order, the customer confirms that the information provided is accurate to the best of their knowledge and that the order is being placed lawfully.

Prescription medications supplied for an individual patient are intended for that patient’s use. They should not be purchased for unauthorized resale, redistribution or transfer to another person. Customers must not submit falsified prescription information or attempt to use the service to obtain a medication in a way that circumvents requirements that would otherwise apply to the prescription.

Global Canadian Pharmacy may refuse further service when information associated with an order gives reasonable grounds to suspect fraud, prescription alteration or another misuse of the pharmacy service.

Third-Party Service Providers

Completing a pharmacy order can involve companies other than Global Canadian Pharmacy and the dispensing pharmacy. Payment processors, carriers, postal services and other providers may perform specific parts of a transaction. These companies operate their own systems and may be subject to requirements outside the direct control of Global Canadian Pharmacy.

Their involvement does not give them authority to make medical or dispensing decisions concerning a prescription. Where a separate provider has its own terms governing the service it performs, those terms may also apply to that part of the transaction.

Changes in Service Availability

A medicine or pharmacy service that is available today may not remain available indefinitely. Manufacturers discontinue products, supply chains change and pharmacies may alter the medicines they are able to dispense. New regulatory requirements can also affect whether a particular product can continue to be offered in a certain location.

Global Canadian Pharmacy may therefore add, remove or restrict medications and services when operational, professional or regulatory circumstances require it. An earlier purchase does not guarantee that the same product, manufacturer, dispensing location or service arrangement will remain available for a future order.

Limitation of Liability

Global Canadian Pharmacy makes reasonable efforts to process orders accurately and to provide customers with the information needed to use the pharmacy service. There are, however, circumstances that can occur outside our direct control. These may include manufacturer shortages, changes in product availability, decisions made by an independent dispensing pharmacy, interruptions involving carriers or postal services, customs delays and actions taken by regulatory or government authorities.

Governing Law

The pharmacy services available through Global Canadian Pharmacy are provided subject to the laws, pharmacy regulations and professional requirements that apply to the parties involved in processing and dispensing an order. Where medication is dispensed through a pharmacy located in another jurisdiction, that pharmacy remains subject to the laws and professional requirements applicable where it operates.

Different parts of an international transaction may therefore be subject to requirements in more than one jurisdiction. Nothing in these Terms of Service is intended to remove or restrict any customer right that cannot legally be waived or limited under applicable law.

Relationship With Other Website Policies

These Terms of Service should be read together with the other policies published by Global Canadian Pharmacy.

Acceptance of the Terms of Service

By requesting pharmacy services through Global Canadian Pharmacy, you acknowledge the conditions described on this page and understand that fulfillment remains subject to medication availability, prescription requirements, pharmacist review and the legal or professional requirements that apply to the order.

No website order can require a pharmacist to dispense a medication contrary to professional judgment or applicable law. When a requirement prevents an order from being completed as submitted, Global Canadian Pharmacy may request additional information, provide an available option where appropriate, or decline to proceed with the order.
